تبحث شبكة الفنون الأدائية الفلسطينية عن خبير/ة قانوني/ة في السياسات والقوانين المتعلقة في قطاع الثقافة والفنون في فلسطين؛ لتقديم ورقة بحثية وإدارة سلسلة من النشاطات والمخرجات لصالح شبكة الفنون الأدائية الفلسطينية ضمن مشروع "من التبعية إلى الصمود: نحو قطاع ثقافي فلسطيني مستدام" بدعم من مؤسسة دروسوس.
خلفية عامة:
مؤسسة دروسوس ملتزمة في تمكين المجتمعات التي تعاني من ظروف معيشية صعبة لتعيش حياة كريمة.
بالتعاون مع المؤسسات الشريكة، تطور مؤسسة دروسوس وتدعم المشاريع التي تركز على تعزيز المهارات الحياتية للشباب من خلال تعزيز الإبداع والاستقلال الاقتصادي.
تعمل المؤسسة في سويسرا وألمانيا الشرقية وكذلك في مصر والأردن ولبنان والمغرب وفلسطين وتونس. منهج الاستدامة الذي تتبعه المؤسسة جعل منها شريكاً تنموياً على صعيد عالمي. وهي مستقلة أيديولوجياً وسياسياً ودينياً.
شبكة الفنون الأدائية الفلسطينية أنشئت عام 2015، كحصيلة للتعاون والحوار بين مؤسسات الفنون الأدائية في فلسطين، والمتخصصة في فنون المسرح والسيرك والرقص والموسيقى، لتكون إطاراً جامعاً للمؤسسات الفنية التي تلعب دوراً محورياً في إعلاء قيمة حرية التعبير، وفي تعزيز الهوية الثقافية الفلسطينية، بكامل مكوناتها الفكرية والحضارية والإنسانية، اذ أنشئت الشبكة بناءً على حاجة تلك المؤسسات إلى الترابط والعمل الجماعي لتحقيق الأهداف المشتركة فيما بينها، والتي تتوجت في تشكيل الشبكة التي تعتبر ائتلافاً يضم عدداً كبيراً من أهم مؤسسات الفنون الأدائية في فلسطين ويربط بينها.
تشكل شبكة الفنون الأدائية الفلسطينية عنواناً مهماً في قطاع الفنون الأدائية الفلسطينية، إذ أن مؤسسات الأعضاء في الشبكة مقتنعون بأهمية ترسيخ شبكة متماسكة تشكل عنواناً لوحدتها ورسالتها وقيمها وأهدافها المشتركة. تعزز الشبكة من أهمية ترويج الفنون الأدائية ونشرها فتساهم في نشر الفنون الأدائية وثقافة الفن بشكلٍ عام في المناطق الفلسطينية المهمشة والأقل حظاً من خلال المؤسسات الأعضاء، لوتطمح بأن يكون لها تأثيراً إيجابياً على السياسات المتعلقة في الفن والثقافة في فلسطين، وعلى ازدهار القطاع الأدائي، عبر دعم المؤسسات الثقافية والفنية، وحماية حقوق القطاع الثقافي، وتنمية الانخراط المجتمعي بالفنون، بهدف التطوير والحفاظ على الثقافة الفلسطينية.
نطاق المهمة المطلوبة، وخصائصها:
يطلب من الخبير/ة تصميم ورقة قانونية تفصيلية يتم فيها تقديم مسح تفصيلي لكل القوانين والسياسات الفلسطينية الرسمية التي تؤثر بشكل مباشر أو غير مباشر على المؤسسات الثقافية والفنية والجمعيات العاملة في مجال الفنون والثقافة في فلسطين، بحيث تكون مرجعية أساسية لهذه المؤسسات لقراءة وضعها بهذا الخصوص، ولتستفيد منها في التأثير على السياسات لصالح الدفاع عن حقوق هذه المؤسسات والعاملين فيها من خلال رفع التوصيات التي ستصدر عن الورقة للجهات المختصة المسؤولة عن وضع القوانين والتشريعات المتعلقة في قطاع الثقافة والفنون، والتأثير على السياسات الاستراتيجية المتعلقة بالقطاع.
كما سيطلب من الخبير/ة تيسير حلقات نقاش واجتماعات مع المؤسسات الثقافية الفلسطينية المعنية (ورشتين عمل على الأقل أو حسب الحاجة)، بتنسيق مع شبكة الفنون الأدائية الفلسطينية ومؤسسة دروسوس، وتقديم الورقة المسحية القانونية لمجموعة المؤسسات العاملة في القطاع، من أجل الخروج بتوصيات مشتركة.
Introduction
The Palestinian Performing Arts Network and DROSOS FOUNDATION are looking for a legal expert specializing in policies and laws related to the culture and arts sector in Palestine; To present a research paper and manage a series of activities and outputs for the Palestinian Performing Arts Network within the project “From Dependence to Resilience: Towards Sustainable Palestinian Cultural Sector” with the support of Drosos Foundation.
General Background
“DROSOS FOUNDATION is committed to enabling people in difficult situations to live a life in dignity. Together with partner organizations, it develops and supports projects that focus on strengthening the life skills of young people by promoting creativity and economic independence. The Foundation is active in Switzerland and eastern Germany as well as in Egypt, Jordan, Lebanon, Morocco, Palestine, and Tunisia. Its distinct sustainability approach has made the Foundation an internationally renowned development partner. It is ideologically, politically, and religiously independent.”
The Palestinian Performing Arts Network was established in 2015 as an umbrella framework for artistic institutions that play a collective role in promoting Palestinian cultural identity and the value of freedom of expression. PPAN is the fruit of many years of continuous dialogue and intense collaboration among Palestinian performing art institutions, specializing in dance, music, circus, and theatre, with whom they have long and valuable experience in the performing arts field in Palestine. These institutions felt the need to integrate their work, experiences, and coordination into a program that would result in the formation of a permanent institutional framework encompassing a large number of Palestinian performing arts institutions.
- PPAN has become a major address within the Palestinian performing arts sector. Palestinian performing arts organizations are convinced of the importance of cementing a network that represents an address to their unity, collectiveness, and shared missions and values. Through these institutions, the network has created accessibility to performing arts and continues to promote art and culture in political, social, and economically marginalized Palestinian communities, and through its vision and mission, the network strives to promote performing arts to influence cultural policies within the national and economic context, empower art and cultural organizations, protect the rights of the sector and increase society's appreciation for performing arts.
Purpose and Scope of Assignment
The expert is expected to design a legal paper, which provides a detailed analysis of all official Palestinian laws and policies that directly or indirectly affect cultural and artistic institutions, to be used as a basic reference for these institutions to map their status in this regard. The paper will be used in an attempt to influence policies in favor of defending the rights of these institutions and their employees, by submitting a recommendation to the specialized authorities responsible for developing laws and legislation related to the culture and arts sector, and influencing the strategic policies related.
The expert is also expected to facilitate discussion sessions and meetings with several Palestinian cultural institutions (at least two workshops or as needed), in coordination with the Palestinian Performing Arts Network and Drosos Foundation, and to present the legal analytical paper to the group of institutions from the sector, to come up with common recommendations.

- تقديم النسخة النهائية للورقة البحثية مع التوصيات الصادرة عن المؤسسات خلال ورشات العمل.
- التحضير لاجتماع تقييم للمخرجات وللعملية بشكل عام مع المؤسسات والأفراد المعنيين.
المنهجية:
الخبير/ة سيقترح المنهجية الفضلى لتنفيذ المطلوب، وسيعمل بشكل مباشر مع موظفي شبكة الفنون الأدائية ومؤسسة دروسوس الذين سيشكلون حلقة الوصل بين الخبير/ة والمؤسسات الثقافية فيما يخص الاجتماعات وتبادل المعلومات. كما يطلب من الخبير/ة إعداد تقرير أولي شامل للتواريخ والمواعيد المتوقعة، ويوضح فيه المنهجية التي ستتبع في العمل، والأدوات والمقاييس التي ستستخدم لجمع المعلومات، وكيفية تصميم ورشات العمل، ثم تقديم ورقة توصيات مبدئية تعرض للشبكة وللمؤسسات الثقافية، لجمع الملاحظات وتقييمها، والتعديل عليها.
الإطارالزمني
سيتم العمل على تصميم ورقة التوصيات من نهاية شهر أيلول حتى العاشر من كانون أول من العام الحالي 2022، بما في ذلك ورشات العمل والاجتماعات مع شبكة الفنون الأدائية الفلسطينية والجهات المعنية، بما لا يزيد عن 50 يوم عمل في المجمل.
الإنجازات المتوقعة:
يطلب من الخبير/ة القانوني/ة تقديم التالي في نهاية العقد:
- خطة عمل شاملة، تحدد فيها المنهجية التي ستتبع خلال العمل، وجدول مواعيد مقترح ضمن الفترة المحددة للعمل، والمواعيد النهائية لتتنفيذ وتسليم المتطلبات.
- تقديم مسودة أولية للورقة البحثية، وعرضها للنقاش والملاحظات.
- إدارة وتحضير ورشات العمل مع المؤسسات والجهات المعنية.
- تقديم ورقة بحثية نهائية تشمل التوصيات النهائية.
المؤهلات والخبرات والمهارات الرئيسية للخبير/ة القانوني/ة
يجب أن يمتلك المرشح/ة المهارات والكفاءات التالية:
- شهادة بكالوريوس على الأقل في أحد حقول العلوم الاجتماعية، ويفضل إجازة في القانون.
- المعرفة الجيدة بالمشهد الثقافي الفلسطيني بشكل عام.
- خبرة عمل واسعة في مجال القانون، والاطلاع على القوانين والسياسات النافذة في المجال الثقافي.
- مهارات جيدة في التحليل، وكتابة التقارير والتوثيق.
- مهارات جيدة في التواصل والتنسيق وإدارة ورشات العمل.
- إتقان التحدث والكتابة في اللغتين العربية والإنجليزية.
The consultant will be responsible for undertaking the following tasks:
- Coordinating with the Palestinian Performing Arts Network and Drosos Foundation as needed.
- Preparing a detailed work plan that includes a clear time limit for submitting the paper in its final form.
- Conducting interactive workshops, including brainstorming and constructive dialogue with cultural institutions and individual artists, to identify priorities and goals that they seek to achieve, based on the results of the paper.
- Submitting an initial draft of the legal research paper, which explains the framework, forms, and effects of laws and policies related to the cultural sector.
- Presenting a final version of the research paper that includes the recommendations issued by the institutions during the workshops.
- Preparing for an evaluation meeting of the outputs and the process in general with the concerned institutions and individuals.
Methodology
The methodology will be proposed by the consultant. The expert will work closely with PPAN staff and the DROSOS FOUNDATION, who will form the link between the expert and the cultural institutions in terms of meetings and information exchange. In addition, the expert is expected to prepare a comprehensive preliminary report for the expected dates and timeline, in which the methodology, tools, and standards that will be used to collect information are explained.
The expert is expected to provide an explanation of the methodology used to design workshops, and then submit a recommendations paper that will be presented to the network and cultural institutions, to collect observations, evaluate them, and modify them.
Timeframe
The recommendations paper will be prepared from September until December 10th 2022, including workshops and meetings with the Palestinian Performing Arts Network and stakeholders, with a total of 50 working days maximum.
Key deliverables
The consultant should submit the following key deliverables:
- A comprehensive work plan, specifying the methodology to be followed during the work, including a proposed schedule within the specified period of work, and the deadlines for implementing and delivering the requirements.
- Submitting an initial draft of the research paper, and presenting it for discussion and comments.
- Managing and preparing workshops with relevant institutions and authorities.
- Submit a final research paper that includes the final recommendations.
Key qualifications, experience, and skills of the consultant
The candidate should possess the following skills and competencies:
- At least a bachelor's degree in one of the social science fields, and a law degree is preferred.
- Good knowledge of the Palestinian cultural scene in general.
- Extensive work experience in the field of law, and familiarity with the laws and policies in force related to the cultural field.
- Good in analysis, report writing, and documentation skills.
- Good communication, coordination, and workshop management skills.
- Fluency in speaking and writing Arabic and English.
